These Terms of Service set out how YatGo operates, how bookings are managed, and the responsibilities of clients across our Kenyan transport network.
What YatGo Is: YatGo Logistics Solutions ("YatGo") is a managed dispatch logistics company serving Nairobi and across Kenya. The company operates a technology-enabled logistics coordination platform that connects customers and clients requiring transport services with verified independent Transport Service Providers ("Transporters"). Through its platform, YatGo facilitates the booking and dispatch of transport services, assigns vetted and approved Transporters, and provides communication, monitoring, and real-time tracking of deliveries from initiation to completion.
YatGo maintains a professionally managed dispatch system that includes operational oversight, vetting of Transporters, and end-to-end delivery coordination to promote efficiency, accountability, and service quality across all transactions conducted through its platform. However, YatGo's role remains strictly that of a logistics coordinator. The actual carriage and transportation of goods are undertaken solely by independent Transporters operating under independent contractor arrangements.
Accordingly, YatGo does not act as a carrier, owner of transport vehicles, or employer of drivers, but instead provides coordination, monitoring, and support services to facilitate seamless transport and logistics operations across Kenya.
By accessing or using the YatGo platform (website, mobile application, WhatsApp booking channel, or any related service), you confirm that you are at least 18 years of age, have read and understood these Terms, have the legal capacity to enter into a binding agreement under the laws of the Republic of Kenya, and agree to be fully bound by these Terms of Service.
If you are using YatGo on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms. If you do not agree to any part of these Terms, you must immediately stop using the platform.

To use YatGo as a Client, you must:
YatGo reserves the right to suspend or permanently deactivate any account found to be in violation of these Terms, without prior notice, at its sole discretion.
All delivery bookings shall be made exclusively through the YatGo platform. Upon submission of a booking request, YatGo's operations team shall review the request, confirm availability, issue a final price quotation, and assign a vetted Transporter. No Transporter shall be assigned, and no job shall be confirmed, until the Client has expressly accepted and confirmed the quoted price.
Upon booking confirmation, the Client shall be provided, through the platform, with identifying details of the assigned Transporter for verification purposes, including the Transporter's full name, passport photograph (where applicable), vehicle make and model, and vehicle registration number. This information is provided solely to enable the Client to verify the correct Transporter and vehicle upon arrival.
All communication between the Client and the Transporter shall be facilitated strictly through YatGo's official operations channels. The Transporter's personal contact details, including phone numbers, shall not be disclosed directly to Clients at any time.
YatGo will not transport the following goods under any circumstances:

The Client acknowledges and agrees that any failure to accurately declare the contents or characteristics of the goods shall result in the assumption of all associated risk by the Client and shall void any claim against YatGo arising from such non-disclosure or misrepresentation.
Failure to accurately declare goods may void any liability or compensation claim. YatGo accepts no responsibility for loss or damage arising from inaccurate or incomplete goods declarations.
The following cancellation policy applies to all confirmed bookings:

Cancellation fees are calculated as a percentage of the confirmed booking value communicated at the time of booking confirmation and are retained by YatGo to cover operational and Transporter mobilisation costs incurred. Any refundable balance will be processed within 24 hours via the original payment method.
YatGo reserves the right to cancel a booking if a suitable Transporter is unavailable. In such circumstances, the Client will receive a full refund of any amount paid within 24 hours.
Upon confirmation of a booking, the Client shall be provided, through the YatGo platform, with relevant details of the assigned Transporter for purposes of identification, transparency, and service coordination. Such information shall include the Transporter's full name, vehicle make, model, colour, and registration number, the Transporter's performance rating on the YatGo platform, and the designated YatGo operations contact for communication.
Where a Driver is deployed in connection with the transport service, such Driver shall at all times be deemed to be acting under the authority, control, and responsibility of the Transporter, and shall not create any separate contractual relationship between the Driver and the Client. The Transporter shall remain fully responsible and liable for the performance, execution, and completion of all transport services under this Agreement, including the acts and omissions of any Driver engaged or deployed by the Transporter.
Transporters' personal phone numbers are not disclosed to Clients. All direct communication is channeled through YatGo's operations team to maintain accountability and prevent off-platform arrangements.
Clients are advised to verify, before handing over goods, that the arriving vehicle's registration number plate matches the registration shown on the platform. If the vehicle does not match, the Client must refuse handover and contact YatGo operations immediately on +254 729 335 085.
Upon completion of each job, the Client may rate the Transporter on a five-star scale and provide written feedback through the YatGo platform. Such ratings and feedback shall form part of the Transporter's performance record and may be used by YatGo for purposes of monitoring service quality, operational management, and allocation of future bookings.
Transporters who consistently receive low ratings or negative feedback may, at YatGo's sole discretion, be subject to corrective measures including but not limited to retraining, suspension from the platform, or permanent removal from the YatGo network.
All transactions conducted through the YatGo platform shall be denominated in Kenya Shillings (KES). The Client shall be obligated to pay the full quoted price for each confirmed booking, in full before dispatch, as specified at the time of booking confirmation. Clients based outside Kenya may settle payments via international bank transfer; all such payments shall be converted to Kenya Shillings (KES) at the prevailing exchange rate on the date payment is received and confirmed by YatGo.
YatGo shall accept payment through approved channels, including M-Pesa (for Kenya-based Clients), international bank transfer, and such other digital payment methods as may be communicated via the platform from time to time. Cash on delivery may be permitted at YatGo's sole discretion for specified categories of services.
Unless otherwise expressly stated, all prices quoted are inclusive of applicable taxes. YatGo reserves the right to review and revise its pricing structure at any time; however, any such changes shall not affect bookings that have already been confirmed at the previously agreed price.
Transporters are not authorised to accept payments outside the YatGo platform or operations channel. Any direct payment to a Transporters that bypasses YatGo is at the Client's sole risk and is not covered by these Terms.
YatGo operates strictly as a technology-enabled platform and logistics coordinator facilitating the connection between Clients and independent Transporters. YatGo does not act as a carrier, transporter, freight forwarder, or bailee of goods, and at no point takes possession, custody, or control of any goods.
All transport services are performed solely by the Transporter as an independent contractor. Accordingly, all obligations and liabilities relating to the transportation, handling, custody, and delivery of goods rest exclusively with the Transporter.
The Transporter shall maintain, at a minimum, valid third-party motor vehicle insurance in accordance with the Traffic Act (Kenya), and such additional insurance (including goods-in-transit insurance) as may be required by YatGo from time to time.
YatGo does not provide, procure, or underwrite any insurance cover for Transporters, goods, or vehicles. Failure to maintain valid insurance shall constitute a material breach and may result in immediate suspension or termination.
All risk in and to the goods shall transfer to the Transporter immediately upon collection from the Client or the Client's authorised representative and shall remain solely with the Transporter until confirmed delivery to the designated recipient. During this entire period, the Transporter shall bear full and exclusive legal responsibility for the goods and the performance of the transport services, including but not limited to loss, theft, or damage to goods, personal injury or death, damage to third-party property, road traffic accidents, and any regulatory or statutory breaches arising in connection with the services.
YatGo shall not, under any circumstances, be obliged to compensate Clients for any loss, damage, delay, or claim arising from transport services. However, where YatGo elects, strictly on a without prejudice, goodwill, and commercial basis, to make any payment to a Client, such payment shall not constitute an admission of liability, acceptance of legal obligation, or assumption of responsibility by YatGo.
All such amounts shall be fully recoverable from the Transporter, and YatGo shall retain an immediate, full, and unconditional right of recovery against the Transporter for any sums so paid.
Any claim for loss or damage must be reported to YatGo within twenty-four (24) hours of the scheduled delivery time via info@yatgo.co.ke or WhatsApp +254 729 335 085. All claims must include: photographic evidence where applicable, a full description of the goods and their declared value at the time of booking, job reference details (or booking details where no reference exists), and any other relevant supporting documentation.
Claims submitted after twenty-four (24) hours shall not be considered under any circumstances. This strict timeline is imposed to prevent fraud and ensure operational integrity.
Where YatGo, in its sole discretion, reviews a claim, any assessment shall be based strictly on the declared value of the goods at the time of booking, available photographic and documentary evidence, findings of YatGo's internal investigation, and any applicable insurance arrangements maintained by the Transporter.
Any approved goodwill payment, where made, shall be processed within fourteen (14) business days of validation.
YatGo shall not provide compensation for:
For the avoidance of doubt, YatGo shall not be liable for any indirect or consequential losses arising from transport services.
Note: General traffic conditions in Nairobi are not considered force majeure as they are a normal and expected operating condition. Delays caused solely by traffic do not exempt YatGo or Transporters from their delivery obligations.
Clients transporting goods of significant value are strongly advised to arrange independent cargo insurance before booking. YatGo's compensation assessment is limited to the declared value submitted at the time of booking. YatGo accepts no liability beyond the declared value under any circumstances.
YatGo may suspend or terminate any Client account immediately and without notice for any of the following:
Suspended Clients may submit a written appeal to info@yatgo.co.ke within 7 days of suspension. YatGo will respond within 5 business days.
Clients who attempt to engage YatGo Transporters directly for off-platform work - whether during or after using YatGo's services - may have their accounts permanently suspended without refund of any amounts paid. YatGo reserves the right to pursue damages against any Client found to have deliberately solicited Transporters away from the YatGo platform. This clause is made pursuant to the Law of Contract Act (Cap. 23, Laws of Kenya).
All content on the YatGo platform including text, graphics, logos, software, trademarks, and design is the exclusive property of YatGo Logistics Solutions. No part of the platform may be copied, reproduced, distributed, modified, or used for commercial purposes without prior written consent from YatGo. Unauthorised use of YatGo's intellectual property may result in legal action under the applicable intellectual property laws of Kenya.
YatGo shall not be liable for any failure or delay in performance of its obligations where such failure or delay results from any cause genuinely beyond YatGo's reasonable control, including but not limited to: floods, fuel shortages, government actions, civil unrest, road closures ordered by public authorities, or acts of God.
Important: General traffic conditions in Nairobi are not considered force majeure and do not excuse delayed or failed deliveries. Transporters are expected to account for normal traffic conditions when planning routes and departure times.
In genuine force majeure circumstances, YatGo will notify the Client as soon as reasonably practicable and will work to resume normal service without undue delay. This clause is consistent with the Law of Contract Act (Cap. 23, Laws of Kenya).
These Terms are governed exclusively by the laws of the Republic of Kenya. Any dispute arising from or in connection with these Terms shall be resolved as follows:
Nothing in this clause prevents YatGo from seeking urgent injunctive relief from a Kenyan court where necessary to protect its interests or prevent irreparable harm.
If any provision of these Terms is found to be invalid or unenforceable under Kenyan law, that provision shall be modified to the minimum extent necessary to make it enforceable. All remaining provisions shall continue in full force and effect. The English language version of these Terms is the definitive and governing version.
YatGo reserves the right to amend these Terms at any time. Clients will be notified of material changes via email or WhatsApp at least 7 days before changes take effect.
